Form N-400 Naturalization Pathways
Lawful permanent residents (green card holders) can qualify for US naturalization under either the general 5-year statutory rule or the expedited 3-year spousal rule.
5-Year General Naturalization
The primary naturalization category for permanent residents who obtained green cards through employment, family preference, asylum, diversity visa, or cancellation of removal.
- 5 Years as Permanent Resident: Continuous lawful status for at least 5 years preceding filing (can file up to 90 days early).
- 30 Months Physical Presence: Must have been physically within the US for at least 913 days (30 months) out of the 5-year statutory period.
- 3-Month District Residence: Resided for at least 3 months in the state or USCIS service district having jurisdiction over the application.
- Good Moral Character: Clean conduct record for the full 5-year lookback period.
3-Year Spousal Naturalization
An expedited pathway for lawful permanent residents who are married to, and actively cohabiting in marital union with, a United States citizen spouse.
- 3 Years as Permanent Resident: Held LPR status continuously for at least 3 years before filing (90-day early filing permitted).
- Living in Marital Union: Continuously married to and residing with the same US citizen spouse for all 3 full years.
- Spouse US Citizenship: Spouse must have held US citizenship for the entire 3-year statutory period.
- 18 Months Physical Presence: Physically present in the US for at least 548 days (18 months) of the 3 years.
Physical Presence & Good Moral Character (GMC)
Trip Duration & Residence Breaks
Trips outside the US impact continuous residence:
- • Under 6 Months: Does not disrupt continuous residence.
- • 6 to 12 Months: Rebuttably presumed to break continuity (requires proof of ongoing US ties, mortgage/lease, tax returns).
- • 1 Year or More: Automatically terminates continuous residence (resets statutory clock unless Form N-470 filed).
Good Moral Character (GMC)
USCIS reviews moral conduct across the 5-year (or 3-year) statutory period:
- • Tax Compliance: All federal, state, and local taxes must be filed or on an active IRS payment plan.
- • Child Support: Must demonstrate timely compliance with all court-ordered family support obligations.
- • Selective Service: Males residing in US between ages 18-26 must prove registration.
Statutory Bars & Pitfalls
Certain offenses permanently or conditionally bar naturalization:
- • Permanent Bars: Murder conviction or Aggravated Felony on or after Nov 29, 1990.
- • Conditional Bars: Crimes Involving Moral Turpitude (CIMTs), 2+ DUI convictions, false claim to US citizenship, or unlawful voting.
- • Probation Status: Cannot naturalize while on active criminal probation.
English & Civics Test Exemptions
Federal statute provides age-based and medical waivers for the standard English speaking, reading, writing, and 100 civics questions requirements.
Exempt from English language testing. You may take the civics exam in your native language with a qualified interpreter. Must study standard civics test questions.
Exempt from English language requirement. You take the civics exam in your native language with an interpreter. Must answer 6 of 10 civics questions correctly.
Exempt from English test AND given a simplified 20-question civics list (marked with asterisks). You only study 20 designated questions instead of 100.
Full waiver of English and civics requirements certified by a licensed medical doctor or clinical psychologist due to physical or developmental disability or mental impairment.
Standard 100 Civics Questions Exam Format
During the interview, the USCIS officer asks up to 10 oral questions from the official 100 civics questions bank covering American Government, American History, and Integrated Civics.
Form N-600: Citizenship Acquisition & Derivation
Many individuals are already US citizens without realizing it through their parents under the Child Citizenship Act of 2000 (CCA) or birth abroad to US citizen parents.
A child born outside the US automatically becomes a US citizen upon meeting all four criteria before turning 18:
- At least one parent is a US citizen by birth or naturalization.
- The child is under 18 years of age.
- The child is a lawful permanent resident (green card holder).
- The child resides in the US in the legal and physical custody of the US citizen parent.
A child born abroad acquires citizenship at birth if their US citizen parent met statutory physical presence in the US prior to the child's birth:
- Two US Citizen Parents: One parent must have resided in the US prior to birth.
- One US Citizen Parent: Parent must have 5 years of physical presence in US (at least 2 after age 14) before birth.
- Evidence: Form N-600 secures a Certificate of Citizenship (or apply directly for a US Passport via Form DS-11).
Military Naturalization & Special Provisions
Expedited naturalization pathways honoring US Armed Forces members, veterans, and surviving spouses.
Peacetime Military (INA § 328)
Service members with at least 1 year of honorable active duty or reserve service can apply for naturalization with fee exemptions and waived residence requirements while in service.
Designated Hostilities (INA § 329)
Immediate naturalization eligibility during designated periods of armed conflict (including the post-9/11 period). Zero required period of prior lawful permanent residence.
Expedited Spousal (INA § 319(b))
Spouses of US citizens stationed abroad (military, foreign service, or qualifying US multinational corporation) can naturalize immediately without prior US residency or physical presence.
